SPIN AXIS Ride Waiver, Risk Warning, Release & Indemnity

1. Participation in SPIN AXIS Rides

1.1 Adherence to these Terms
These terms govern your participation in every SPIN AXIS Ride. To take part in any SPIN AXIS ride, you must accept and adhere to these Terms at all times. DO NOT PARTICIPATE IN ANY SPIN AXIS RIDE IF YOU DO NOT ACCEPT THESE TERMS.

Ride Leaders and SPIN AXIS reserve the right to remove any Rider who is not complying with these Terms or is deemed to be riding unsafely from the ride. This may include excluding the Rider from future SPIN AXIS Rides. You are required to follow any such direction.

1.2 Your Responsibility for Skill and Experience
It is your responsibility to ensure you possess the necessary skills, experience, preparation, and equipment for any SPIN AXIS Ride you choose to join. You affirm and warrant that:

(a) You are 18 years of age or older;

(b) You have the appropriate skills, health, fitness, and experience to participate in the specific SPIN AXIS Ride;

(c) Your bike is road-legal, well-maintained, has functional brakes, and is appropriately set up for the ride conditions;

(d) You are capable of performing basic bike repairs without assistance; and

(e) You are self-sufficient for the duration of the ride, including carrying necessary items such as water, food, lights, and a repair/tool kit.

You acknowledge that SPIN AXIS does not provide on-road support during rides and is not responsible for mechanical repairs, medical assistance, or any other services.

2. Acknowledgement of Risks

You recognize and accept that:

(a) SPIN AXIS Rides take place on public roads, and as recreational activities, they involve significant physical exertion, inherent risks, and potential dangers; and

(b) You are personally liable for any costs or fees arising from accidents that involve or are caused by you. This includes fees from emergency services such as Police, Air Ambulance, Fire and Rescue, and the Ambulance service.

You understand that it is your sole responsibility to follow all rules related to participation in a SPIN AXIS Ride, including ensuring your personal safety and the security of your belongings, as well as being physically and mentally prepared for the event.

This acknowledgment serves as a risk warning under relevant State Consumer Law and any other applicable regulations.

3. Directions and Safety

3.1 SPIN AXIS Directions
You agree to follow all reasonable instructions provided by Ride Leaders, including guidance on speed, directions, or route adjustments.

3.2 Road Safety
When participating in a SPIN AXIS Ride, you must:

(a) Obey all road rules related to bicycle riding applicable in the state where the SPIN AXIS Ride occurs;

(b) Wear a helmet that meets the latest safety standards such as EN1078, ANSI Z90/4, or SNELL throughout the ride;

(d) Carry a functioning mobile phone and valid identification.

3.3 Emergency Situations
In the event of an accident where you are incapacitated and unable to call emergency services, you agree that a Ride Leader or another rider/public member may do so on your behalf.

3.4 Conduct
All Riders are expected to conduct themselves in a manner that upholds the reputation of both themselves and SPIN AXIS. Specifically, you agree:

(a) To show consideration for others while riding, whether on or off-road;

(b) That aggressive or erratic behavior, whether violent or abusive, directed towards Ride Leaders, fellow riders, other road users, or the public, will not be tolerated. Offenders may be asked to leave the ride immediately and may be barred from future rides; and

(c) To properly dispose of any litter during the ride and to avoid littering. Riders found littering may be banned from future events.

3.5 Insurance
SPIN AXIS strongly recommends that all Riders obtain personal liability insurance suitable for participation in SPIN AXIS Rides. You acknowledge that:

(a) Other participants in SPIN AXIS Rides may or may not have their own rider insurance; and

(b) Without suitable insurance, you may be personally liable for any losses arising from your participation in a SPIN AXIS Ride.

4. Liability and Waiver

(a) To the fullest extent allowed by law, SPIN AXIS and its Representatives disclaim any liability (including in relation to warranties or guarantees) for any loss, damage, or injury to you or your belongings resulting from your participation in a SPIN AXIS Ride, including any death, physical or mental injury, or worsening of any pre-existing condition.

(b) You agree to indemnify and hold SPIN AXIS and its Representatives harmless from any claims, liabilities, losses, damages, legal proceedings, or actions, including reasonable attorney fees and any settlements arising from your conduct or participation in a SPIN AXIS Ride.

(c) Nothing in these Terms excludes, limits, or modifies the application of Consumer Law or any rights or remedies conferred by Consumer Law where doing so would violate the applicable Consumer Law. Where permissible by law, the maximum liability of SPIN AXIS and its Representatives for a breach of any non-excludable guarantee under Consumer Law is limited to the resupply of the SPIN AXIS Ride or an amount equivalent to the cost of resupplying the SPIN AXIS Ride to you or your nominee.
